Le stage permis d'exploitation est une formation préalable obligatoire pour toute personne qui aspire à l’ouverture ou à la gestion d’un débit de boissons. Le principe est loin d’être une mesure répressive. Conformément à la loi n°2006-396 du 31 mars 2006, son rôle est d’assurer le bon déroulement des activités liées à la vente de boissons.

Depuis peu, le permis d’exploitation est ouvert à toute personne résidant dans l’hexagone, citoyen Français ou non. Cependant, il existe deux types de formations disponibles dans la région de Normandie :

Le permis d’exploitation 2,5 jours pour les exploitants novices.
Le permis d’exploitation 1 jour pour les exploitants expérimentés.

L’intérêt du stage permis d’exploitation en région Normandie

Tous les nouveaux exploitants de débit de boissons doivent se soumettre à la formation permis d’exploitation 2,5 jours avant toute procédure administrative. Ce stage a une validité de dix ans. Au-delà de cette période, le permis d’exploitation nécessite une mise à jour.

La formation permis d’exploitation 1 jour est le processus de recyclage légal et obligatoire pour les exploitants souhaitant prolonger de dix ans leur droit d’exercer. Son objectif est de :

Responsabiliser et sensibiliser l’exploitant sur les risques liés à la vente et à la consommation d’alcool dans les établissements.
Connaître l’ensemble des sanctions applicables en cas de manquement à la loi.
Connaître ses droits et ses obligations.
Savoir comment gérer son personnel et les mesures de sécurité applicables à son établissement.

Le contenu de la formation en région Normandie

Comme son nom l’indique, le stage permis d’exploitation dans la région de Normandie se déroule en une journée et s’étale sur une période de 7 heures. Il n’existe pas d’horaires officiels pour le déroulement du stage. Toutefois, l’administration conseille de commencer le stage à 8h30 et de le clôturer à 17h30. Bien sûr d'un établissement de formation à un autre, les horaires peuvent varier, voire s'adapter aux emplois de temps des élèves.

Le programme du stage

Ce programme n'est rien d'autre qu'une remise à niveau, ce qui fait que le stage permis d’exploitation 1 jour est moins consistant que celui de 2,5 jours. Cependant, son programme comporte tous les points importants relatifs à l’activité des débiteurs de boissons :

Rappel des responsabilités civiles et pénales du gérant du débit de boisson.
Rappel du règlement sur l’affichage obligatoire.
La protection des mineurs.
Le respect de l’ordre public.
Les conditions de revente du tabac.
La règlementation locale.
La lutte contre le bruit.
Les règles de protection sur les consommateurs.
Les fermetures administratives.
La règlementation locale sur la gestion des débits de boisson.

La formation coûte environ 200 euros et se déroule en deux volets :

Un volet théorique utile pour assimiler les connaissances.
Un volet pratique utile pour tester les candidats.
